are the operators (hereinafter referred to as "we" or "operators") of the websites www.touchingcode.com, www.apmato.com, www.app-erstellen.com (hereinafter referred to as "website") and the services offered thereon and are therefore responsible for the collection, processing and use of personal data in accordance with Article 4 No. 7 DS-GVO and the German Telemedia Act (Telemediengesetz, TMG). The principle of data economy is of great importance to us as early as the data collection stage. We collect and process personal data only if you have given us permission to do so, or if the law expressly permits us to do so, or if we are required to do so by law, or if you permit us to do so. In the following we will explain which data we collect, how we use it and what rights you have with regard to the use of your data by us:

COLLECTION AND STORAGE OF PERSONAL DATA

1. Personal data
The term personal data is defined in the Federal Data Protection Act (Bundesdatenschutzgesetz). According to this, these are individual information about the personal or factual circumstances of a specific or identifiable natural person. This includes, for example, your civil name, your address, your telephone number or your date of birth. Furthermore, this also includes company-related data.

2. Collection
a) when visiting our website
Unless otherwise stated in the following sections, no personal data will be collected, processed or used when using our website. When you visit our website, our servers temporarily store each access in a log file. The following data is collected without your intervention and stored by us on a server in Germany until it is automatically deleted after 3 days at the latest: - the IP address assigned to your computer, - the name and URL of the requested file, - Referrer URL (the previously visited page), - Date and time of the request, - the browser version you are using

b) If you contact us by e-mail or our contact form, we will store your e-mail address and other details. This is done solely for the purpose of replying to you or, if necessary, to contact you again at a later date about the subject of the enquiry.

c) when subscribing to a newsletter
You have the possibility to subscribe to our newsletter. For this we need a valid e-mail address from you. Optionally, you can enter further data, e.g.
- First name
- Surname
- Address or similar information voluntarily.

This data will only be used for sending the newsletter. When you register for the newsletter, we also store your IP address and the date of registration. This storage of the IP address and the date serves solely as proof in the event that a third party misuses an e-mail address and registers for receiving the newsletter without the knowledge of the authorised party. To send our newsletter we cooperate with the list provider MailChimp, an offer of The Rocket Science Group, LLC, 512 Means Street, Suite 404, Atlanta, GA 30318 ("Rocket"). Rocket signed the Safe Harbor Agreement on July 22, 2008, which is a data protection agreement between the European Union and the United States. The data stored during registration will be transferred to Rocket and stored by Rocket. The data entered during registration will not be transferred to other third parties. After registration, MailChimp will send you an e-mail to confirm your registration (double opt-in procedure). In addition, MailChimp offers various analysis options on how the sent newsletters are opened and used, e.g. how many users an e-mail was sent to, whether e-mails were rejected and whether users unsubscribed from the list after receiving an e-mail. However, these analyses are only group-related and are not used by us for individual evaluation. MailChimp also uses the Google Analytics analysis tool from Google, Inc. and may include it in its newsletters. Further information on data protection at MailChimp can be found at:http://mailchimp.com/legal/privacy/We will only use the personal data collected from you in the context of the e-mail newsletter internally to optimise and deliver the newsletter you expressly requested. Your personal data will not be sold or passed on to third parties for advertising, market or opinion research purposes. Should you no longer wish to receive newsletters from us at a later date, you can object to this at any time without incurring any costs other than the transmission costs according to the basic tariffs. A message in text form to the contact data provided further down (e.g. e-mail, fax, letter) is sufficient for this. Of course, you will also find a link in every newsletter to unsubscribe.

3. Storage
We store and process your personal data on our own servers in Germany. We protect your data with technical and organizational security measures in order to minimize risks in connection with loss, misuse, unauthorized access and unauthorized disclosure and alteration of this data. For this purpose, firewalls and data encryption are used for example, but also physical access restrictions and authorization controls for data access. We take measures to ensure that the personal data we collect is accurate and up to date. You can withdraw your consent to the use of your personal data at any time. If you withdraw your consent to the use or transmission of your personal data for the purposes set out in this Privacy Policy, we may no longer be able to provide you with access to our website, applications or tools or to provide the services and customer services offered to our users and authorized in accordance with this Privacy Policy and our Terms of Use.

USE OF PERSONAL DATA
The collection and processing of your personal data is carried out to process the mutual contractual relationship, in particular for the following purposes: - to have knowledge of who our contractual partner is; - to check the data entered for plausibility and legal capacity of the users; - to establish contractual relationships with you regarding the use of the website and the services offered on it, to design the content, process and, if necessary, change them; - to be able to contact you in the event of queries; - to inform you about future offers, provided that you have expressly consented. The aforementioned data will be pseudonymised before it is evaluated. In this way, we can evaluate user behaviour without concrete personal reference in order to improve our website and services. You can object to the use of your personal data for advertising purposes at any time, either as a whole or for individual measures. An informal communication in text form to the contact date provided further down (e.g. e-mail, fax, letter) is sufficient for this purpose.

DISCLOSURE OF DATA
1. Transfer of personal data to third parties. Your personal data will only be passed on to third parties or otherwise transmitted if this is necessary for the purpose of processing the contract or if you have given your prior consent. We will not sell or otherwise pass on your data to third parties without your consent. Something else only applies if there is a legal obligation to do so (e.g. information to certain authorities as part of their statutory duties) or if this is necessary to enforce our rights, in particular to enforce claims arising from the contractual relationship with you.
2. Integration of third-party services and content. It is possible that third party content, such as videos from YouTube, map material from Google Maps, RSS feeds or graphics from other websites may be included on our website. This always presupposes that the providers of this content ("third-party providers") perceive the IP address of the users. Without the IP address, they would not be able to send the content to the browser of the respective user. The IP address is therefore required for the presentation of this content. We strive to use only those contents whose respective providers use the IP address only for the delivery of the contents. However, we have no influence on whether the third party providers store the IP address for statistical purposes, for example. As far as this is known to us, we inform the users about it.

COOKIES AND WEB ANALYSIS SERVICES
1. Interactions with our websites are tracked using cookies and the technologies listed below to customize them for you. Cookies are small files that are stored on your hard drive. This makes navigation easier and makes our website more user-friendly. Of course you can also view our website without cookies, but a limitation of its functionality cannot be excluded. Most browsers automatically accept cookies. You can prevent cookies from being saved on your hard drive by selecting "Do not accept cookies" in the browser settings.

2. Google Analytics
We use Google Analytics, a web analytics service provided by Google Inc., 1600 Amphitheatre Parkway, Mountain View, CA 94043 USA, hereinafter referred to as "Google", on our site. Google Analytics uses "cookies", which are text files placed on your computer, to help the website analyze how users use the site.
